These Terms and Conditions ("Terms") govern your access to and use of the Site and the purchase of any garment products listed on it, including designer chudidars, leggings, and other apparel. By accessing or using the Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Definitions

• "Customer" / "you" means any person who accesses the Site or places an order.
• "Products" means the goods listed for sale on the Site.
• "Order" means a request placed by a Customer to purchase Products.

2. Eligibility

By using this Site, you confirm that you are at least 18 years of age, or are using the Site under the supervision of a parent or legal guardian, and that you have the legal capacity to enter into a binding contract.

3. Products, Pricing & Availability

• All product descriptions, images, sizes, colours, and fabric details are provided as accurately as possible; however, slight variations in colour or texture may occur due to fabric dyeing processes, screen/display settings, or photography lighting.
• Sizes follow standard garment measurements as listed on the Site (e.g., M, L, XL, XXL). Customers are encouraged to refer to the size chart before ordering, as minor variations of 0.5–1 inch may occur due to manual stitching and fabric behaviour.
• Prices listed on the Site are in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise.
• We reserve the right to change prices, discontinue products, or correct pricing/typographical errors at any time without prior notice.
• Products are subject to availability. In the event an ordered item is out of stock, we will notify you and offer a refund, replacement, or backorder option.

4. Orders & Payment

• Placing an order constitutes an offer to purchase, which we may accept or decline at our discretion (e.g., in cases of suspected fraud, pricing errors, or stock unavailability).
• Payments can be made through the payment methods listed at checkout, including UPI, credit/debit cards, net banking, and other supported gateways.
• All payments are processed through secure third-party payment gateways. We do not store your complete card or banking details.
• An order confirmation email/SMS does not guarantee acceptance of the order; it confirms that we have received your request.

5. Shipping & Delivery Policy

5.1 Processing Time

Orders are typically processed and dispatched within 1–3 business days of confirmation. Made-to-order or customised garments (such as designer chudidars in specific sizes/colours) may require additional processing time, which will be communicated at the time of order.

5.2 Delivery Timelines

• Domestic orders are generally delivered within 4–9 business days from the date of shipment, depending on the destination.
• Delivery timelines are estimates provided by our courier partners and are not guaranteed. Delays may occur due to weather, courier constraints, regional restrictions, festivals, or events beyond our control.

5.3 Shipping Charges

Shipping charges, if any, are calculated at checkout based on the delivery location, order weight, and value. Any free-shipping thresholds or promotional offers will be displayed on the Site at the time of purchase.

5.4 Order Tracking

Once your order is shipped, you will receive a tracking number via email or SMS. You may use this to track your shipment through the courier partner's website.

5.5 Failed or Delayed Delivery

If a delivery attempt fails due to an incorrect address, unavailability of the recipient, or refusal to accept the package, additional shipping charges may apply for re-delivery. Please ensure your shipping address and contact details are accurate at the time of ordering.

5.6 International Shipping

For international/export orders, delivery timelines, customs duties, and import taxes (if any) are the responsibility of the customer and vary by destination country.

6. Cancellation Policy

• Orders may be cancelled free of charge before they are shipped/dispatched. Please contact us as soon as possible to request a cancellation.
• Once an order has been shipped, it cannot be cancelled, but may be eligible for return as per our Return & Refund Policy below.
• Customised or made-to-order products cannot be cancelled once production has begun.

7. Return, Refund & Exchange Policy

7.1 Eligibility for Returns

• Returns and exchanges are accepted within 7 days of delivery for eligible garments.
• Garments must be unused, unworn, unwashed, and returned in their original condition with all original tags, labels, and packaging intact.
• Garments showing signs of wear, alteration, staining, or odour (e.g., perfume, deodorant) will not be accepted for return or exchange.
• Size-related exchanges (e.g., wrong size ordered) are subject to stock availability of the requested size/colour.

7.2 Non-Returnable Items

• Customised or made-to-order garments (e.g., made in a size/colour not stocked on the Site)
• Garments marked as "Final Sale" or purchased during clearance/end-of-season sale offers
• Innerwear, or any garment where a return is restricted for hygiene reasons, if applicable

7.3 Damaged, Defective, or Incorrect Items

If you receive a damaged, defective, or incorrect product, please contact us within 48 hours of delivery with photographs of the product and packaging. We will arrange a replacement, exchange, or full refund after verification.

7.4 Refund Process

Approved refunds will be processed to the original payment method within 7–10 business days of the returned product passing quality inspection. 8. Intellectual Property

10. Limitation of Liability

To the maximum extent permitted by law, Ashu Designs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or Products, including but not limited to delays in delivery, minor variations in fabric colour/texture or stitching, or issues caused by third-party courier or payment service providers. Our total liability for any claim arising from an order shall not exceed the amount paid by you for that order.

11. Indemnification

You agree to indemnify and hold harmless Ashu Designs, its employees, and affiliates from any claims, damages, or expenses arising out of your misuse of the Site or violation of these Terms.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Tirupur, Tamil Nadu.

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
